These Terms and Conditions set out the basis on which Waste Clearance Merton provides waste collection and clearance services to domestic and commercial customers. By making a booking, confirming a quotation, or allowing our operatives to carry out any work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 "Company" means Waste Clearance Merton, the waste clearance provider supplying the services.

1.2 "Customer" means any individual, business, organisation, or other entity that requests or receives services from the Company.

1.3 "Services" means any waste collection, rubbish clearance, bulky waste removal, garden waste removal, household junk collection, commercial waste clearance, or related services provided by the Company.

1.4 "Waste" means items, materials, and rubbish presented for removal that the Company agrees to collect as part of the Services, subject to these Terms and any applicable law or regulation.

1.5 "Booking" means a request by the Customer for Services, whether made by telephone, email, online form, or any other communication method accepted by the Company.

1.6 "Quote" means a price or estimate provided by the Company for the Services.

1.7 "Contract" means the agreement between the Customer and the Company for the provision of Services, comprising these Terms and Conditions and any confirmed Quote or booking details.

2. Scope of Services

2.1 The Company provides waste clearance and rubbish removal services for domestic and commercial customers within its designated service area. The specific type and volume of waste to be collected shall be as agreed between the Company and the Customer at the time of booking.

2.2 The Company reserves the right to decline any booking where the waste type, volume, or access conditions fall outside its operational or regulatory capabilities.

2.3 The Customer acknowledges that the Company does not provide skip hire, hazardous waste transport (unless expressly agreed and correctly licensed), demolition services, or any service not expressly described as part of a confirmed Quote.

3. Booking Process

3.1 Bookings may be made by telephone, email, or via any online booking facility operated by the Company.

3.2 At the time of booking, the Customer must provide accurate information, including but not limited to:

(a) The address where the waste is located and any special access details.

(b) The type and approximate volume or weight of the waste to be collected.

(c) Any items that may be hazardous, restricted, or require special handling.

3.3 Any Quote provided based on information given by the Customer prior to the attendance of the Company’s operatives is an estimate only. The final price may be adjusted upon inspection of the waste at the collection site.

3.4 A booking is deemed accepted and a Contract formed when the Company confirms the booking time and date, either verbally or in writing, or when the Company attends the site and begins providing the Services.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that the Company has safe, lawful, and reasonable access to the waste at the agreed date and time.

4.2 The Customer is responsible for ensuring that:

(a) Any necessary permissions, permits, or consents for access and clearance are obtained.

(b) The waste is clearly identifiable and separated where required.

(c) There are no health and safety hazards that have not been disclosed to the Company in advance.

4.3 If access is not available or is unsafe, or if the waste significantly differs from the description given at the time of booking, the Company may cancel the visit, reschedule, or adjust the Quote. In such circumstances, the Customer may be liable for a call-out or wasted journey fee.

5. Quotes, Pricing, and Additional Charges

5.1 The Company may provide a Quote based on a description of the waste or after a site visit. All Quotes are exclusive of any applicable VAT unless stated otherwise.

5.2 The final price is determined by various factors, which may include volume of waste, weight, type of material, loading time, access conditions, and disposal costs.

5.3 The Company reserves the right to amend any Quote if:

(a) The actual waste differs in quantity or nature from that originally described.

(b) Additional services are requested by the Customer.

(c) There are delays caused by the Customer or circumstances under the Customer’s control.

5.4 Waiting time and extra labour may be charged if the Company’s operatives are kept waiting or are required to undertake significantly more work than reasonably anticipated.

6. Payments and Invoicing

6.1 Payment is due upon completion of the Services, unless otherwise agreed in writing prior to the commencement of the work.

6.2 The Company accepts payment methods as notified to the Customer, which may include cash, card payment, or bank transfer.

6.3 For commercial Customers or account holders, invoices will be issued with specified payment terms. Unless agreed otherwise, payment terms are 14 days from the invoice date.

6.4 If any amount due is not paid by the due date, the Company reserves the right to:

(a) Charge interest on overdue sums at the statutory rate permitted under UK law.

(b) Suspend or cancel any further Services to the Customer.

(c) Recover any reasonable costs incurred in pursuing payment, including debt recovery and legal costs.

7. Cancellations and Rescheduling

7.1 The Customer may cancel or reschedule a booking by giving the Company reasonable notice by telephone or email.

7.2 If the Customer cancels within 24 hours of the scheduled collection time, the Company reserves the right to charge a cancellation fee to cover costs and lost capacity.

7.3 If the Customer fails to be present (where required) or fails to provide access at the agreed time, this may be treated as a late cancellation and may incur a call-out or wasted journey fee.

7.4 The Company may cancel or reschedule a booking at any time due to reasons including, but not limited to, operational issues, vehicle breakdown, adverse weather, staff illness, safety concerns, or legal or regulatory constraints. The Company will endeavour to notify the Customer as soon as reasonably possible and to reschedule at a mutually convenient time.

8. Waste Types, Prohibited Items, and Regulations

8.1 The Company will only collect waste that is legally permissible and that it is licensed and equipped to handle.

8.2 Certain items are prohibited or may only be accepted by prior arrangement. These may include, but are not limited to, asbestos, chemicals, solvents, paints, oils, gas bottles, medical waste, clinical waste, explosives, and other hazardous materials.

8.3 The Customer must inform the Company in advance if any such items are present. The Company reserves the right to decline collection of prohibited or hazardous items, to make additional charges, or to require specialist handling arrangements.

8.4 The Company operates in compliance with applicable UK waste management regulations and duty of care requirements. Waste will be transported to authorised facilities for recycling or disposal in accordance with statutory obligations.

8.5 Where required, the Company will issue appropriate documentation in relation to waste transfer in compliance with applicable law. The Customer is responsible for retaining any such documentation for their records.

9. Title, Risk, and Ownership of Waste

9.1 Ownership of waste transfers from the Customer to the Company once the waste is loaded onto the Company’s vehicle and the Customer has made payment or agreed to pay the relevant charges.

9.2 Once the waste has been loaded, the Customer no longer has any rights in relation to the waste, save for any rights imposed by law.

9.3 Risk in relation to the waste passes to the Company upon loading, except where loss or damage is caused by inaccurate information provided by the Customer or by items concealed within the waste that pose safety or regulatory issues.

10. Liability and Limitations

10.1 The Company will exercise reasonable care and skill when providing the Services. However, the Company shall not be liable for any damage to property or possessions where:

(a) Such damage arises from pre-existing structural defects, weakness, or poor condition.

(b) The Customer has failed to notify the Company of relevant risks or hazards.

(c) Access routes are inherently difficult, restricted, or hazardous and the Customer has requested that the work proceed regardless.

10.2 The Customer is responsible for protecting driveways, floors, and surfaces where they may be at risk from vehicles, equipment, or movement of waste. The Company will not be liable for cosmetic or surface damage resulting from normal operations where reasonable care has been taken.

10.3 To the extent permitted by law, the Company shall not be liable for any indirect or consequential loss, loss of profit, loss of business, or loss of opportunity arising out of or in connection with the Services.

10.4 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be excluded or limited.

10.5 Subject to clause 10.4, the Company’s total liability to the Customer arising from or in connection with any single incident or series of connected incidents shall not exceed the total amount paid or payable by the Customer in respect of the Services giving rise to the claim.

11. Customer Indemnity

11.1 The Customer shall indemnify and keep indemnified the Company against all claims, costs, damages, losses, and expenses incurred by the Company arising out of:

(a) Any breach by the Customer of these Terms and Conditions.

(b) Any incorrect or incomplete information provided by the Customer.

(c) The presence of hazardous or prohibited materials within the waste that were not disclosed at the time of booking.

12. Environmental Commitment

12.1 The Company aims to divert waste from landfill where reasonably practicable through reuse and recycling initiatives within the UK waste management framework.

12.2 The Company does not guarantee that any particular item will be recycled, reused, or disposed of in a specific manner, but will act in compliance with relevant environmental regulations.

13. Complaints and Dispute Resolution

13.1 If the Customer is dissatisfied with any aspect of the Services, the Customer should notify the Company as soon as possible, providing full details of the issue.

13.2 The Company will investigate complaints promptly and will endeavour to resolve any issues through discussion and, where appropriate, remedial action.

13.3 In the event that a dispute cannot be resolved informally, either party may pursue any remedies available under UK law.

14. Data Protection and Privacy

14.1 The Company will collect and process personal data relating to the Customer for the purposes of administering bookings, providing Services, handling payments, and managing customer relationships.

14.2 The Company will handle personal data in accordance with applicable UK data protection legislation and will take reasonable steps to safeguard such information.

14.3 The Customer agrees that their contact details may be used for service-related communication. The Customer may request that their information is updated or that non-essential marketing communication is ceased, subject to legal obligations.

15. Force Majeure

15.1 The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, extreme weather, industrial disputes, transport failures, power outages, or legal restrictions.

15.2 In such circumstances, the Company will use reasonable endeavours to resume normal operations as soon as practicable and to keep the Customer informed.

16. Variations to These Terms

16.1 The Company reserves the right to amend or update these Terms and Conditions from time to time.

16.2 Any changes will take effect upon publication or notification and will apply to all Services booked thereafter. The Terms and Conditions applicable to a particular Contract are those in force at the time of booking, unless otherwise agreed in writing.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms and Conditions or the provision of the Services.

18. General Provisions

18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

18.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

18.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations, provided such assignment or subcontracting does not materially affect the Customer’s rights under the Contract.

18.4 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior understandings, representations, or agreements, whether oral or written.
